Complaints about Tax Credit overpayments

We receive many complaints from tax credit claimants who disagree with the recovery of an overpayment. You cannot appeal about an overpayment but you can ask the TCO to reconsider their decision to recover it. Like the TCO, we can only consider the recovery of overpayments in the light of their Code of Practice 26 (COP 26).

If we are satisfied that the TCO have properly considered COP 26 and that their decision is reasonable, we will not ask the TCO to write off an overpayment.
